Currently, residents of San Leandro are not permitted to use Airbnb, Vrbo, HomeAway or any other rental services due to zoning law problems in the town. However, officials are now considering allowing the rentals in residential districts. Council members are still discussing the proposed changes. Currently, there’s no time frame available on when or if officials will modify the law.

Update: As a host in San Leandro, new regulations in 2019 require you to secure a business license and register their property with the city. The property must be your primary residence. In-law suits or secondary dwelling units are prohibited. Additional standards include the following for short-term rental properties:

  • All hosted short-term rentals are limited to a total of 180 calendar days per permit term. Portions of calendar days shall count as full days.
  • The dwelling unit that includes the hosted short-term rental must be the permittee’s primary, permanent residence.
  • The dwelling unit must have a smoke detector, a fire extinguisher, a carbon monoxide detector, and adequate egress, all as required by current codes and regulations.
  • The permittee must inform and update the City regarding what advertising platforms are in use to advertise the dwelling unit for hosted short-term rental.

Is your short-term rental also your primary residence?
